Welcome to Earth Crust Minerals Analytical Laboratory (ECMA Labs). By submitting samples, requesting laboratory services, or using our website, you acknowledge and agree to the following Terms & Conditions.
Scope of Testing

Test results relate only to the sample(s) received and tested by ECMA Labs.

Unless otherwise stated, samples are tested in the condition in which they are received.

Test results shall not be considered representative of any other batch, shipment, lot, or material.
Sample Submission
Clients are responsible for ensuring that:

Samples are properly packed and labeled with unique identification.
-
A completed Sample Submission Form accompanies every sample.
-
Accurate sample descriptions and relevant information are provided.
-
Minimum sample quantity requirements are fulfilled.
ECMA Labs reserves the right to reject samples that are:

Improperly packed
-
Insufficient in quantity
-
Contaminated
-
Hazardous or unsafe for laboratory handling
Sample Collection
-
Client-collected samples remain the sole responsibility of the client.
-
Laboratory sampling services may be provided upon request and may incur additional charges.
-
ECMA Labs is not responsible for the representativeness or quality of samples collected by the client.
Testing Services
-
Testing shall be performed using:

International Organization for Standardization (ISO)
-
Indian Standards (IS)
-
ASTM Standards
-
British Standards (BS)
-
Japanese Certified Reference Materials (JCRM)
-
Customer-approved methods, where applicable
-
Any deviation from standard testing methods will be clearly stated in the final report.

Additional tests requested after sample registration may attract additional charges.
Quality Assurance
ECMA Labs operates under a documented Quality Management System to ensure:

Reliable and accurate analytical results
-
Use of calibrated and maintained instruments
-
Certified reference materials
-
Qualified and trained personnel
-
Compliance with national and international testing standards
Measurement uncertainty shall be reported wherever required by the applicable test method or customer specification.
Turnaround Time (TAT)
-
Turnaround Time begins after sample registration and payment confirmation (where applicable).
-
Estimated delivery timelines are indicative and may vary depending upon:

Sample complexity
-
Number of requested parameters
-
Laboratory workload
-
Instrument availability
-
ECMA Labs shall not be liable for delays beyond its reasonable control.
Test Reports
-
Test reports apply only to the submitted sample(s).
-
Reports shall not be reproduced, modified, or published in part without prior written permission from ECMA Labs.
-
Unauthorized alterations or partial reproduction shall render the report invalid.
-
Digitally authorized electronic reports shall be considered valid without a physical signature.
-
Opinions or interpretations, when specifically requested, are based solely on analytical findings and shall not be construed as product certification or regulatory approval.
Pricing & Payment
-
Charges shall be governed by the agreed quotation, purchase order, or invoice.
-
Reports may be withheld until outstanding payments have been cleared.
-
Urgent or priority testing services may incur additional charges.
Confidentiality
-
ECMA Labs treats all customer information with strict confidentiality.

Sample information

Test data
-
Analytical reports
-
Commercial information
-
Technical documents
Information shall only be disclosed: -
With written customer authorization
-
Where required by applicable law
-
Where required by accreditation or regulatory authorities
Sample Storage & Disposal
Unless otherwise agreed in writing:

Samples shall normally be retained for 10 days following issuance of the test report.
-
After the retention period, samples may be disposed of without further notice.
-
ECMA Labs shall not be responsible for samples after disposal.
Retention of Laboratory Records
-
Original analytical records, calculations, and laboratory reports shall be retained according to ECMA Labs' Quality Management System and applicable regulatory requirements.
Complaints & Appeals
-
Clients may submit complaints regarding laboratory services or test reports:

In writing
-
Within 7 days from the date of report issuance
-
All complaints and appeals shall be investigated and handled according to ECMA Labs' documented quality procedures.
Re-testing
Re-testing shall only be performed:
-
Upon customer request
-
Subject to sample availability
-
Using the retained portion of the original sample
-
Provided the sample remains stable and suitable for analysis
Subcontracting
-
Where specialized testing is unavailable in-house, ECMA Labs may subcontract specific analyses to competent laboratories.
-
Where required, customers shall be informed before subcontracting.
Client Responsibilities
-
Clients agree to:
-
Provide accurate sample information.
-
Declare hazardous, radioactive, explosive, toxic, or infectious materials before submission.
-
Follow all sample submission guidelines.
-
Use laboratory reports responsibly and without unauthorized modification.
Laboratory Liability
ECMA Labs exercises the highest level of professional care throughout the testing process.
However:

The laboratory shall not be liable for losses resulting from incorrect or non-representative sampling performed by the client.
-
ECMA Labs shall not be responsible for commercial decisions based solely upon laboratory reports.
-
Liability shall be limited to the laboratory fees paid for the specific testing service.
-
The laboratory shall not be liable for indirect, consequential, incidental, or business losses arising from the interpretation or use of test results.
Safety Requirements

Clients must disclose any samples containing:

Toxic substances
-
Hazardous chemicals
-
Radioactive materials
-
Explosives
-
Biohazardous materials
-
ECMA Labs reserves the right to refuse testing of unsafe samples.
Force Majeure
ECMA Labs shall not be held liable for delays or failure to perform services resulting from events beyond reasonable control, including but not limited to:

Natural disasters
-
Fire
-
Flood
-
Earthquake
-
Power failures
-
Equipment breakdown
-
Pandemic or epidemic
-
Government restrictions
-
Industrial disputes
-
Transportation disruptions
Intellectual Property
All reports, analytical data, laboratory formats, procedures, graphics, website content, and documentation remain the intellectual property of ECMA Labs unless otherwise agreed in writing.
Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of the Republic of India.
-
Any dispute arising from laboratory services shall be subject to the exclusive jurisdiction of the competent courts at Beawar, Rajasthan, India.
